Did you know that registered medical marijuana patients are protected from workplace discrimination in Pennsylvania?

Well, they are – courtesy of the Commonwealth’s 2016 Medical Marijuana Act, aka MMA. Not only did the MMA legalize marijuana possession and use for medical cardholders, but it also provided protection for workers. The MMA includes the following:

“No employer may discharge, threaten, refuse to hire, or otherwise discriminate or retaliate against an employee regarding an employee’s compensation, terms, conditions, location or privileges solely on the basis or such employee’s status as an individual who is certified to use medical marijuana.”

The MMA does not mean employees are free to be under the influence at work, and employers can refuse to hire or employ medical marijuana patients for high-risk or dangerous jobs.  Basically, employers have the duty to keep their workplaces as safe as possible.

That said, employers can’t discriminate against job applicants or employees because of their status as registered medical marijuana patients.
